The hearing of the first lawsuit filed in Germany against BioNTech, the company that produced the first vaccine against Covid-19, was held.
A woman who said that the vaccine developed by BioNTech, founded by Turkish scientists Özlem Türeci and Uğur Şahin, had side effects, started the lawsuit in Hamburg demanding at least 150 thousand euros in compensation due to “previously unexplained side effects”.
The woman, whose name has not been released, announced that she was working with the law firm Rogert & Ulbrich.
According to German law, the woman who did not reveal her name; she stated that she was exposed to side effects such as weakness, insomnia and chest pain.
BioNTech, on the other hand, argued that drugs and vaccines have side effects and these have been scientifically announced before, and underlined that these side effects are also included in the prospectuses.
It is estimated that approximately 1.5 billion people worldwide have the Comirnaty vaccine, while this number is 64 million in Germany.
He argued that he lost his sight
Joachim Ceasar-Preller, the lawyer of Dietmar Scherer, another name who claimed compensation for the alleged side effects of the Covid-19 vaccine in the case, which was heard on July 3, said, “Our client is suffering a lot because he has lost his sight. This is no small thing. We do not say that we are against the vaccine. Of course not. But at the end of the day, we want the harms of the vaccine to be revealed.” he said.
WHO WILL PAY THE COMPENSATION?
The European Medicines Agency (EMA) announced that Comirnaty, developed by BioNTech, is safe. It is not yet known which party will pay compensation if BioNTech is found guilty.
It has been suggested that the European Union member states’ governments are among the possible options to pay compensation, since the European Union purchases bulk vaccines from BioNTech/Pfizer. But this issue has not been clarified yet.
While the German law firm Rogert & Ulbrich announced that it has 250 clients suing for damages due to the side effects of the Covid-19 vaccine, another German company Caesar-Preller announced that it will defend the rights of 100 clients.
Case was seen last month. However, the claimant’s “rejection was delayed due to the request of the judge”. The first hearing of the postponed case was held in Rottweil. It is not yet known when the court will conclude. But this isn’t the only lawsuit filed against BionTech. There are different lawsuits filed in Italy on similar grounds.
